INTRODUCTION


The purpose of this document is to describe and inform you of the way in which THUASNE, SAS, with a share capital of €1,950,000, registered in the Nanterre Trade and Companies Register under No. 542 091 186, having its registered office at 120, rue Marius Aufan 92300 LEVALLOIS-PERRET, France, acting as Data Controller, undertakes to collect, use and protect your Personal Data in the context of your use of the thuasne.com, thuasne-group.com and services.thuasne.com domains, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("GDPR"), with all due care and exclusively for the legitimate purposes for which they were collected.

1. DEFINITIONS


For the purposes of the Privacy Policy, the following terms are defined as follows:   
"Site": means collectively the websites:   
thuasne.com/countries (one url for each country)  
thuasne-group.com  
services.thuasne.com  
and includes all their functions and services.   
"Services": refers to the functionalities and services offered by THUASNE via the Site.   
"User(s)   " or "you": refers to you as a user of the Site.   
"we", "us" and "our": refers to THUASNE.    
"Personal Data" or "Data": refers to personal data as defined in Article 4.1 of the GDPR. 


2. WHAT DATA DO WE COLLECT AND WHY?


As part of the use of the Site, THUASNE collects, uses and retains Personal Data concerning You to meet several objectives:


2.1.    To process a complaint or answer your questions


When you contact us through the Site to request information, we process Personal Data that you communicate to us to respond to your request. 

In this context, we may process your surname and first name, your e-mail address, the content of your correspondence with us, your questions and any other data that you provide spontaneously in the course of your exchanges with our services. The compulsory or optional nature of the Personal Data requested is indicated by an asterisk.


2.2.    When creating your user account


When you create an account on our Site to join the THUASNE community and benefit from the Services mentioned in our Terms of Use, you agree to provide us with the following Personal Data: Gender, First name, Last name, Date of birth, E-mail address. 

If you wish to benefit from personalized advice and content adapted to your needs, you may also choose to provide us with information about your pathology. However, this information is not compulsory for the creation of your account, and you are free to indicate it or not.  


2.3.    For sales or marketing purposes 


We may send you newsletters to present to you our new products, information and advice, as well as to inform you of news from our group if you have expressly agreed to this when creating your user account.

In this context, we process your contact details and your identity, i.e. your e-mail address, your surname and your first name. You may withdraw your consent at any time and unsubscribe by clicking on the link provided at the bottom of our newsletters or by contacting us at: digital.marketing@thuasne.fr


2.4.    To improve the performance and functionality of our Site


When you browse our Site, we collect technical data so that you can benefit from its functions. This technical data is necessary for the proper functioning of the Site. 

When you accept cookies, we process technical data from your device such as your IP address, the browser you are using, the pages you have consulted on the Websites in question, the way you use them (browsing and clicks) and the duration of your sessions.

This enables us to measure the Site's audience and to manage and improve its performance.


3. WHAT ARE THE LEGAL GROUNDS AUTHORISING US TO PROCESS YOUR DATA? 


The processing of your Data for the aforementioned purposes is justified by the following legal grounds:   
•    when processing is justified by our legitimate interest (Art. 6.1 f, RGPD), for example to answer your questions or to ensure the proper functioning of our site.   
•    when you have expressly consented to the processing of your Data (Art. 6.1 a, RGPD), for example in connection with the transmission of a newsletter.  
•    when the processing of your Data is linked to the performance of a contract concluded or to be concluded between you and THUASNE (Art. 6.1 b, RGPD), for example if you are a customer of THUASNE.


4. HOW LONG IS YOUR DATA KEPT?


Your Personal Data is kept for the period necessary to achieve the objectives of the processing operations we carry out or for the period defined by the regulations.  

We may also retain your data for the duration of the limitation period established by law, where such a period is applicable, even when the objectives pursued by the processing carried out have been achieved. 

We delete your Data linked to your user account three (3) years after the last connection to your account on the Site, your last contact with us or the last click in one of our e-mails, unless you ask us to delete your Data before this period. 

You may request the deletion of your account and data at any time by contacting us at:digital.marketing@thuasne.fr .

If you no longer wish to receive newsletters, you can unsubscribe by clicking on the link at the bottom of our e-mails. 


5. WHO USES YOUR DATA AND WHO CAN ACCESS IT? 


The Data we collect is intended for THUASNE's internal departments. However, we may share your Data when you use our Site and our Services, when this is necessary for the management of the Site and the provision of the associated Services.

Under no circumstances will THUASNE transmit your Data to third parties for other commercial and/or promotional purposes without your consent. THUASNE reserves the right to transmit Data to its service providers acting as data processor within the meaning of the GDPR, exclusively to achieve the purposes mentioned in this document.  

We also inform you that we may be required to share your Data with the relevant administrative or judicial authorities upon request, if required by the applicable regulations.


6. WHERE IS YOUR DATA STORED? 


Your data is stored on servers located in the European Union. 

However, we may transfer your data to processors located outside the European Union, in particular in the United States. When we transfer your data to our processors located in the United States, we ensure that they have adhered to the EU-US Data Privacy Framework governing data transfers between the European Union and the United States, in accordance with the adequacy decision issued by the European Commission on 10 July 2023. 

If one of our processors transfers your Personal Data outside the European Union to a country that has not been the subject of an adequacy decision by the European Commission, we ensure that the subcontractor undertakes to provide for and implement security measures and a specific framework (European Commission standard contractual clauses, BCR, etc.).


7. HOW IS YOUR DATA SECURED?


We do everything possible to protect your Data and prevent data breaches or hacking.

To guarantee the confidentiality, integrity and availability of your Data, we implement a number of security measures, in particular: 

o    Encryption of data in transit between your browser and our Website, as well as data stored on our servers.

o    We take care to maintain our Site at an optimum level of security in accordance with current recommendations.

o    Rigorous access controls to data are strictly limited to THUASNE and its subcontractors or authorized third parties who need it in order to provide the Services. Specific levels of access are defined according to the responsibilities of each individual.

8. WHAT COOKIES DO WE USE AND HOW DO WE MANAGE THEM?

In accordance with the provisions of Law no. 7817 of 6 January 1978 on data processing, data files and individual liberties and EU Regulation 2016/679 on data protection of 27 April 2016, you have the following rights in principle:   
•    a right of access and rectification allowing you to modify, complete or update your Personal Data;   
•    a right to erasure of your Data;   
•    a right to object to the processing of your Data for legitimate reasons;   
•    the right to define directives concerning the fate of your Data after your death;   
•    a right to the portability of Data, in a structured, commonly used and machine-readable format;   
•    a right to limit the data processing carried out, under the conditions referred to in Article 18 of European Regulation 2016/679 of 27 April 2016 ;

10. INFORMATION CONCERNING THE PRESENCE OF LINKS TO OTHER WEBSITES


Our Site may contain links to other platforms or services of the Thuasne Group and/or third parties. This Privacy Policy only governs the use of all content on the Site.  

Be sure to read the documentation and privacy policy of all external services and websites linked to the Site. The Thuasne Group cannot be held responsible for elements related to the protection of personal data or any other element on external sites not managed by Thuasne Group companies. 


11. MODIFICATION OF THE PRIVACY POLICY AND VERSIONS


We reserve the right to modify this Privacy Policy at any time, so we invite you to consult it regularly. Modifications and clarifications will come into effect immediately after their publication on the Site. If we make any changes to the content of this Policy, we will notify you here of the update so that you are aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. 

Furthermore, in the event of any contradiction or difference between the provisions of this French version of the Privacy Policy and the English version made available on the Site, the French version shall prevail.
